Terms of Service

The short version

You can use Subdiview to browse real estate listings and connect with a Subdiview agent. Listing data is provided by MRED MLS and we cannot guarantee its accuracy; verify anything important with a licensed agent. Don’t scrape the site. If something goes wrong, our liability is limited. Disputes get resolved in Illinois.

Who we are

Subdiview is a neighborhood-first real estate search platform operated by Brokerocity Inc., a licensed Illinois real estate brokerage (License #478026081). When we say “Subdiview,” “we,” or “us” in these terms, we mean Brokerocity Inc.

Your right to use the service

We give you a personal, limited, non-transferable license to use Subdiview to research properties for sale, save listings you’re interested in, and connect with a Subdiview agent about a potential purchase. This license is for your own use, not for redistributing data to others.

Listing data — important limitations

The listings on Subdiview come from MRED’s IDX data feed. The information is supplied by MRED member brokerages and is deemed reliable but not guaranteed. We display it as MRED provides it. Square footage, lot dimensions, taxes, schools, HOA fees, and any other listing detail can be wrong, stale, or incomplete. Verify any detail that matters to you with a licensed agent before relying on it.

Listing photos are owned by the listing brokerage, MRED, or the photographer. We display them under the IDX license. You may not download, redistribute, or use them for any purpose other than personal research.

You may not scrape, crawl, mass-extract, or systematically copy listing data from Subdiview. Doing so violates both these terms and the MRED IDX rules, and can result in account termination and referral to MRED for enforcement.

Working with a Subdiview agent

When you contact a Subdiview agent through the site, you are connecting with a licensed Illinois real estate agent affiliated with Brokerocity Inc. The agent does not represent you in a buyer-broker capacity until both parties sign a written buyer brokerage agreement. Until that agreement is signed, the agent is providing customer-level service and may, depending on the listing, represent the seller.

Phone and SMS consent

When you provide your phone number to a Subdiview agent, you consent to be contacted by phone, text, or both about the property you inquired about and related real estate matters. Standard carrier rates apply. Reply STOP to any text to opt out of further messages, or email privacy@subdiview.com. You do not have to consent to phone or text messages as a condition of using Subdiview; you can browse without signing up.

Your account

Subdiview uses passwordless email sign-in (magic links). You are responsible for keeping your email account secure. We can suspend or close your account if you misuse the service, including by attempting to scrape data, by harassing a Subdiview agent, or by providing false contact information to circumvent the gate.

No warranty

Subdiview is provided as-is. We do not warrant that it will be uninterrupted, error-free, or that the listing data is accurate. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Subdiview and Brokerocity Inc. are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total liability for any claim arising out of these terms is limited to the greater of $100 or the amount you have paid us in the past twelve months. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the fullest extent permitted.

Disputes

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising out of these terms or your use of Subdiview will be resolved in the state or federal courts located in McHenry County, Illinois, and you consent to the personal jurisdiction of those courts.

Changes

We may update these terms from time to time. The date at the top of the page reflects the most recent meaningful change. Material changes will be highlighted in the site footer or via email to active account holders. Continued use of the service after changes take effect constitutes your acceptance of the new terms.
